Federal Circuit Axes Stryker Unit’s Sterilized Wipe Patents

The Federal Circuit upheld an administrative tribunal’s invalidation of two skin-sterilization patents owned by a unit of Stryker Corp.

The court agreed with the Patent Trial and Appeal Board that the Sage Products LLC patents, describing a sterilization cloth and method, were anticipated by a United Kingdom regulator’s report on a different product called ChloraPrep. Judge Leonard P. Stark wrote that “substantial evidence supports the board’s finding” that ChloraPrep anticipated and invalidated Sage’s US Patent Nos. 10,398,642 and 10,688,067 in a precedential opinion issued Tuesday by the US Court of Appeals for the Federal Circuit.
