Federal Circuit Appears Skeptical of Intel Escape in VLSI Suit

An appeals court seemed open to reviving VLSI Technology LLC’s California patent suit against Intel Corp., homing in on a stipulation made in the early stages of the eight-year-old case that VLSI says eviscerates Intel’s winning defense.

The three-judge panel at the US Court of Appeals for the Federal Circuit appeared receptive to VLSI’s argument that Intel waived its argument that it performed steps required for VLSI’s US Patent No. 8,566,836 only outside of the US.
