Federal Circuit Again Rebuffs Bid to Stop Delaware Funding Probe

The full Federal Circuit refused on Tuesday to rehear a challenge to a Delaware judge’s probe into the financing of patent litigation in his courtroom, after previously refusing to halt the judge’s investigation.

Ten of the court’s 12 judges denied a petition from patent plaintiff Nimitz Technologies LLC to have either a three-judge panel or the full court sitting en banc rehear an earlier Dec. 8, 2022, panel decision.
