Federal Circuit Affirms Rejection of ‘Basin Beverage’ Trademark

The Federal Circuit affirmed a tribunal’s refusal to register “Basin Beverage Co.” as a trademark because there’s “substantial evidence” of consumer confusion with existing marks.

The Trademark Trial and Appeal Board didn’t err in concluding Matthew Amoss’ applications for goods including coffee, beer, and wine are preempted by registrations like “Great Basin Coffee Company” and “New Basin Distilling Company,” according a nonprecedential opinion issued Monday.
