NearMap US Inc. convinced the Federal Circuit that parts of two patents covering the use of aerial photography to measure roof characteristics are obvious and therefore invalid.
The appeals court upheld rulings from the Patent Trial and Appeal Board that Eagle View Technologies Inc’s US Patent Nos. 8,670,961 and 8,078,436 would’ve been obvious when their applications were filed with the US Patent and Trademark Office based on an article on three-dimensional mapping, a textbook on digital photography, and a book called “AutoCAD 2005 for Dummies.”
