‘Fat Bear’ Trademark Not Doomed by Tardy LLC Creation, TTAB Says

Phat Scooters Inc. failed to convince a administratve tribunal to ax a “Fat Bear” trademark registration because purported owner Fatbear Scooters LLC didn’t exist when the mark was granted.

The two cousins who applied for the “Fat Bear” trademark constitute the same commercial enterprise that three years later created the LLC for their existing business after Phat Scooters filed to cancel the registration, the Trademark Trial and Appeal Board ruled. The application’s misidentification of the owner was a “correctable mistake,” because they were the rightful owners off the trademark, the board said.
