FAO Schwarz Owner Gets ‘Big’ Piano Trademark Claims Dismissed

FAO Schwarz’s parent company convinced a federal court in Pennsylvania to throw out a suit alleging it sold unauthorized knock-offs of the piano mat featured in the 1988 Tom Hanks film “Big.”

The U.S. District Court for the Eastern District of Pennsylvania held that it doesn’t have personal jurisdiction over Delaware-based MerchSource LLC. The court rejected arguments from Remo Saraceni, who created the toy in 1982, that a YouTube video of a sales presentation filmed at a QVC studio in Pennsylvania is enough to show MerchSource purposefully availed itself of the forum state.
