Failed Floor Plan Copyright Suits Merit Fee Award, Court Affirms

A home designer failed to convince the Eighth Circuit to nix $235,000 in attorneys’ fees awarded to real estate agents he accused of displaying his copyrighted floor plans in resale listings.

A lower court justifiably found awarding fees warranted because Designworks Homes Inc. and owner Charles Lawrence James made overbroad claims supported with undeveloped arguments and limited evidence, the US Court of Appeals for the Eighth Circuit said. Thursday’s opinion also noted Designworks “unnecessarily” filed two separate lawsuits “based on essentially the same facts” in the US District Court for the Western District of Missouri.
