Express Scripts Fights $43 Million Production Tax Credit Denial

Express Scripts Inc. is seeking to overturn the denial of $42.9 million in tax credits, telling a federal appeals court that the lower court misunderstood the nature of the pharmacy benefit management company’s claims adjudication software.

In a brief filed Thursday with the US Court of Appeals for the Eighth Circuit, the St. Louis-based company accused a federal judge in Missouri of incorrectly determining that Express Scripts’ clients don’t “lease, rent or otherwise dispose of” the software.
