Experian Can’t Shake Suit Claiming Inaccurate Credit Report

Experian must face a consumer’s claims that the company unlawfully issued a credit report inaccurately showing the consumer owed spousal and child support, the Sixth Circuit ruled.

Adam Berry sufficiently pleaded that Experian Information Solutions “failed to follow reasonable procedures” after Berry sent Experian court orders showing he had no outstanding support obligations, Judge Ransey Guy Cole, Jr. said Monday.

A partially divided panel of the US Court of Appeals for the Sixth Circuit reversed a lower court decision granting Experian’s motion for judgment on the pleadings.
