Exclusion of Damages Opinions in Micron Patent Suit Affirmed

Micron Technology Inc. convinced the Federal Circuit not to disturb a lower court ruling that undercut a patent owner’s damages case in an infringement suit over flash memory technology.

The appeals court affirmed orders from a judge in the U.S. District Court for the Northern District of California excluding opinions from MLC Intellectual Property LLC’s damages expert regarding a reasonable royalty rate.

The U.S. Court of Appeals for the Federal Circuit, in a precedential opinion, said Thursday the district court’s orders weren’t an abuse of discretion.
