Everlast World’s Boxing Headquarters Corp. is entitled to over $425,000 in damages based on unpaid royalties from an agreement with Trident Brands Inc. to use its trademarks on fitness products, a Manhattan federal court said.
The U.S. District Court for the Southern District of New York ruled in February that Everlast was entitled to damages after Trident “developed a case of licensor’s remorse” from their agreement. Trident said it spent nearly $3 million in licensing fees—including between $600,000 and $700,000 to Everlast—despite earning less than $100,000 in sales.
