Evenflo Co. escaped an injunction and part of a jury’s $2.9 million damages award for infringing Wonderland Switzerland AG’s car-seat patents, in a mixed Federal Circuit ruling.
No reasonable jury could find that Evenflo’s 4-in-1 convertible car seats infringe Wonderland’s US Patent No. 7,625,043 under the doctrine of equivalents because the claimed locking mechanism had to be located on the seat back itself, not on the seat assembly, Chief Judge Kimberly A. Moore wrote for a divided panel in a precedential opinion issued Wednesday. That vacated the portion of the damages award tied to those products.
