Epsilon’s Patent and Trademark Office Support Award Needs Redo

The U.S. Patent and Trademark Office incorrectly awarded Epsilon Inc. a $47 million blanket purchase agreement to provide support desk services because the winning bid included an assumption that took exception to a material solicitation requirement about the level of expected services, the GAO said.

The protester, Innovative Management & Technology Approaches Inc., showed that the assumption provided that Epsilon would request a price modification if a 10% or greater increase of work occurred, the Government Accountability Office said in a decision released Tuesday.

As a result, Epsilon’s bid was unacceptable and ineligible for award, the GAO said.
