Epic Systems Fails to Get High Court Review of Punitive Damages

Electronic health records company Epic Systems Corp. failed to convince the U.S. Supreme Court to consider reversing an appeals court’s $140 million trim of a $420 million trade secrets award.

Epic still won $280 million from Tata Consultancy Services Ltd. after the U.S. Court of Appeals for the Seventh Circuit deemed the punitive portion of the award excessive and halved it.

Epic had argued that the Seventh Circuit should have deferred to the district court’s judgment and Wisconsin’s law allowing punitive awards of up to double compensatory damages.
