Energizer ‘Black Ice’ Air Freshener Trademark Case Revived

Energizer Holdings Inc. faces revived claims that it infringed trademarks covering a “Black Ice” car air freshener with its competing “Midnight Black Ice Storm” products, after the Second Circuit reinstated the claims Thursday.

Car-Freshner Corp. sells one of the most popular lines of car air fresheners, with scents including Black Ice and Bayside Breeze. After acquiring CFC’s competitor Handstands in 2016, Energizer began selling a car air freshener combining “Midnight Black” and “Ice Storm” scents called “Midnight Black Ice Storm.” Energizer also sold a “Boardwalk Breeze” scent.
