Eli Lilly Allowed Fast Appeal Over Proof Test for Age Bias Class

Eli Lilly & Co. can immediately appeal a ruling that conditionally certified a nationwide class in a bias lawsuit alleging the company favors Millennial workers over employees 40 and older when it comes to promotions.

The pharmaceutical giant and subsidiary Lilly USA LLC correctly argued that identifying the proper test for conditionally certifying a collective action under the Age Discrimination in Employment Act presents a pure question of law on which there is substantial grounds for a difference of opinion, the US District Court for the Southern District of Indiana said.
