The maker of a rehydration drink called “Electrolit” and its exclusive American licensee won partial summary judgment on multiple trademark infringement claims, a federal court ruled.
Sueros & Bebidas Rehidratantes SA de DV, the beverage maker, and the licensee, CAB Enterprises Inc., accused a company called Texas Jasmine of selling a different formula under the Electrolit trade dress.
In addition to granting Sueros and Cab Enterprises summary judgment on six of their claims, the US District Court for the Southern District of Texas also denied Texas Jasmine’s motion to exclude their expert’s report and testimony about differences between the products. ...
