EcoFactor to Appeal Partial Loss in Google Nest Thermostat Trial

EcoFactor Inc. plans to appeal a February jury verdict that ordered Google LLC to pay $20 million for infringing a patent covering energy management with its Nest thermostats, but cleared the tech giant of liability for infringing another and knocked out parts of a third.

EcoFactor, which makes software used by utilities, will ask the US Court of Appeals for the Federal Circuit to examine a final judgment order filed late last month, according to a notice of appeal filed Thursday in a Texas federal court.
