Ecoark Holdings and its Zest Labs unit filed a $2 billion complaint against Walmart in the U.S. District Court for the Eastern District of Arkansas, alleging violations of the Arkansas Trade Secrets Act.
The purported complaint also alleges unfair competition, unjust enrichment, breach of contract, breach of the covenant of good faith and fair dealing, conversion, and fraud.
Zest Labs said it started in 2015 to engage with Walmart to demonstrate how Zest Fresh reduced waste and improved shelf life consistency.
It said it was concerned by how similar the description of Walmart’s Eden—launched in March—was to Zest Fresh.
