Duracell Escapes Energizer’s Bunny Trademark Lawsuit

Battery maker Duracell U.S. Operations Inc. beat back trademark claims from Energizer Brands LLC over the appearance of bunny mascots on Duracell products being sold by some U.S. retailers.

Duracell wasn’t in control of the bunny-branded goods that were appearing at Phillips 66 Co. and Menard Inc. retail outlets, the U.S. District Court for the Eastern District of Missouri ruled Oct. 27, granting summary judgment to Duracell (Energizer Brands, LLC v. Procter & Gamble Co., 2017 BL 385895, E.D. Mo., No. 16-223, 10/27/17).
