DraftKings to Seek Appeal of Order Denying MLB Suit Dismissal

DraftKings Inc. told a federal judge it plans to seek permission to appeal a ruling earlier this month denying its bid to toss out the Major League Baseball players union’s lawsuit accusing it of using players’ images and names without permission.

DraftKings notified the court of its plan to move for certification of an interlocutory appeal in a joint report filed March 21 in the US District Court for the Eastern District of Pennsylvania. Judge Karen S. Marston earlier this month mostly denied the gambling behemoth’s bid to dismiss the Major League Baseball Players Association’s lawsuit.
