DraftKings Inc. told a federal judge to dismiss damages claims in a lawsuit over a soured licensing deal with the National Football League players’ union to use their names, images, and likenesses for a now-shuttered virtual trading card offering.
While the NFLPA’s claims that DraftKings illegally terminated the nonfungible token agreement are “meritless,” its damages claims should be nixed at this stage of the lawsuit because they exceed the limitation of liability, according to the motion to dismiss filed Monday in the US District Court for the Southern District of New York.
