Dish Can’t Net $3.9 Million in Patent Case Fees, Fed. Cir. Told

A district court abused its power in finding that Dish Network LLC and subsidiary Sling TV LLC deserved nearly $4 million in attorneys’ fees based on groundless “red flags” over a patent’s validity, the Federal Circuit was told.

Patent owner Realtime Adaptive Streaming LLC, which accused Dish and Sling of violating a patent covering data compression, said the award insinuates it asserted US Patent No. 8,867,610 in bad faith when it “had every reason to believe in the eligibility of its presumptively valid patent.”
