Dell Should Face Claim It Stole Partner’s Software, Judge Says

Dell Inc. should face trade secrets and contract breach claims saying it ripped off a former partner company’s software to create its own competing product, a Texas federal magistrate judge said.

Hybir Inc.'s complaint sufficiently identified the trade secrets Dell allegedly stole and described the alleged contract breach, Magistrate Judge Dustin M. Howell said Tuesday recommending the US District Court for the Western District of Texas deny Dell’s motion to dismiss. Howell’s opinion also recommended dismissal of a Computer Fraud and Abuse Act claim that Hybir said it “will withdraw,” as it fell outside the laws two-year statute of limitations. ...
