New York-based coffee roaster Death Wish Coffee LLC accused Death Before Decaf Pty. Ltd. of intentionally infringing it’s macabre java trademarks.
The “marginal Australian coffee maker” Death Before Decaf would confuse consumers with its branding, Death Wish told the US District Court for the Southern District of New York Monday. Beyond the name, Death Wish pointed to the skull-and-crossbones imagery of the emblem on the coffee packaging that Death Before Decaf offered for sale into the US through its online store.
