Cytek Beats Becton’s Medical Device Copyright, Breach Claims

Becton Dickinson & Co.'s copyright and breach of contract claims against Cytek Biosciences Inc. for allegedly stealing medical device information were dismissed from San Francisco federal court for being “impermissibly vague.”

Cytek was targeted with trade secret, antitrust, and other claims for allegedly misusing BD’s technology for flow cytometers, which identify, sort, and engineer cells and small particles. BD added copyright and breach claims based on Cytek’s supposed failure to comply with a software license agreement and unauthorized copying of product manuals.
