Cox Communications Inc. claimed in Virginia federal court that music producers misrepresented evidence used to establish infringement by the internet service provider’s users in a trial that led to a $1 billion verdict.
Discovery in a similar copyright case against an ISP revealed data was created years after the alleged infringement, contrary to the plaintiffs’ claims, Cox said as it asked the U.S. District Court for the Eastern District of Virginia to open post-trial discovery.
