Spectrum Solutions LLC successfully defended on appeal a district court ruling that its home saliva-collection kits for Covid-19 testing don’t infringe a DNA Genotek Inc. patent.
The US District Court for the District of Southern California correctly interpreted the term “reagent compartment” as it’s used in the OraSure Technologies Inc. unit’s patent, according to an opinion issued Friday by the US Court of Appeals for the Federal Circuit. That construction led the district court in June 2023 to conclude Spectrum didn’t infringe US Patent No. 10,619,187 or a second patent.
