An inventor group has asked a California federal court to block the Patent Trial and Appeal Board from starting new patent reviews until the patent office creates regulations governing the board’s leeway to deny validity trials.
US Inventor filed for a preliminary injunction that would prevent the PTAB from instituting patent reviews under programs created by the America Invents Act, including the popular inter partes review, pending the completion of rulemaking on discretionary factors.
