A federal district court overseeing a legal battle between luxury dress designer Hayley Paige Gutman and her former employer, wedding dress maker JLM Couture Inc., must reconsider who owns a pair of social media accounts with 1.1 million followers.
The US Court of Appeals for the Second Circuit on Wednesday said the lower court made an error by ruling that JLM was likely to succeed in showing that it owned the disputed accounts. “The Disputed Accounts should be treated in the first instance like any other form of property,” the appeals court said. “This includes determining the original owner.”
