Counterclaims Dismissed in Lottery.com’s Abandoned Secrets Suit

Lottery.com convinced a federal judge to dismiss state-law counterclaims brought by executives of a data company after the online lottery services company abandoned its trade secrets suit against them.

John Brier Jr. and Bin Tu—who said Lottery.com owed them millions in state court before the federal trade secrets suit—failed to persuade the US District Court for the Middle District of Florida to retain jurisdiction over their counterclaims. Factors including judicial economy, fairness, and consideration for state court litigation all weigh in favor of dismissal, the court said in an order Wednesday dismissing the case without prejudice.
