CoStar Must Face CREXi’s Revived Monopoly Claim as Justices Pass

The US Supreme Court declined to review the revival of an antitrust claim brought against real estate information company CoStar Group Inc. in response to its mass copyright infringement suit.

Commercial Real Estate Exchange Inc., known as CREXi, convinced the US Court of Appeals for the Ninth Circuit to revive its claims of anticompetitive conduct by CoStar in June. Those claims followed CoStar’s suit accusing CREXi of infringing copyrights of tens of thousands of images. CREXi alleged CoStar illegally entered de facto exclusive deals and imposed technological barriers to retain its market position.
