The US Copyright Office’s review board affirmed the refusal to register a two-dimensional piece of artwork that “contains more than a de minimis amount of content generated by artificial intelligence.”
The “Théâtre D’opéra Spatial” artwork isn’t eligible for copyright protection because its creator Jason M. Allen refused to disclaim the portions attributable to AI and instead sought to register the entire work, the office said in a letter to his counsel on Tuesday.
After the office held that the registration application “inextricably merged, inseparable contributions” from both Allen and AI service Midjourney, he sought a second reconsideration of the decision. ...
