Copyright Office Unveils Library Opt-Out Plan for Claims Board

Libraries and archives would be able to preemptively opt out of small claims tribunal proceedings at the Copyright Office under a new agency proposal.

Such entities would submit written notification of their intention to opt-out to the Copyright Claims Board, which will determine eligibility, under the proposal scheduled to be published Thursday in the Federal Register.

Libraries and archives are already exempt from liability for copyright infringement under a Copyright Act provision. The proposed rule would make those already exempt under the act’s section 108 also eligible for preemptive opt-out from CCB proceedings.
