The seller of “Feel Free” energy tonic remedied a copyright claim dismissed in April that can now advance in California federal court along with trademark and false advertising allegations.
Botanic Tonics LLC sufficiently alleged that it acquired the right to sue Shot of Joy LLC for ripping off a “Feel Free” user’s video testimonial and adding a graphic of its own product, the US District Court for the Central District of California. The wellness company failed to revive an unfair competition claim because it didn’t plead that the rival’s ad caused a drop in sales beyond a conclusory statement.
