Contract Claim Tossed in Walgreen’s Suit Against Founder’s Heir

Walgreen Co.'s founder’s great-grandson Charles Walgreen again persuaded a federal judge to toss a breach of contract claim from a lawsuit accusing him of infringing and diluting the company’s trademarks by running a company called Walgreen Health Solutions LLC.

Walgreen Co. hadn’t shown how Charles Walgreen had violated a settlement agreement from an earlier trademark dispute by running Walgreen Health Solutions, according to the Thursday opinion from Judge Virginia M. Kendall filed in the the US District Court in the Northern District of Illinois.
