Comcast’s Xfinity My Account app doesn’t infringe a NexStep patent related to streaming customer-support services, a Delaware federal judge ruled, overturning a jury’s decision.
US District Judge Richard Andrews in ruled there wasn’t substantial evidence to support the jury’s September 2021 verdict that Comcast infringed one of NexStep’s patents. The jury cleared Comcast of infringing a second patent.
Andrews said testimony from NexStep’s infringement expert was “too vague to support the jury’s” finding of infringement of U.S. Patent No. 8,280,009 under the doctrine of equivalents, which imposes liability for equivalents to patented technology.
