Coke’s Puerto Rico Bottler Can’t Duck ‘Eco’ Trademark Suit (1)

The bottler of Coca-Cola products in Puerto Rico failed to escape bottled water company Niagara Bottling LLC’s trademark lawsuit over its “Eco-Earth Bottles” packaging.

Niagara plausibly alleged CC1 LP—known as Coca-Cola Puerto Rico Bottlers—infringed its “Eco-Air Bottle” and “Eco-Air Packaging” trademarks, the U.S. District Court for the District of Puerto Rico said. Niagara said CC1’s Nikini brand of bottled water would confuse consumers because the similarly-colored labels included similar emblems to indicate environment-friendly packaging.

Both companies use circular white logos on blue backgrounds with green outlines incorporating green leafs to indicate lighter and more environmentally-friendly packaging, Niagara alleged. The parties ...
