Coke Wins Claim That Wholesale Distributor Copied Thums Up Mark

The Coca-Cola Co. won its claim that a wholesale distribution company used its logos and trade dress of its beverages sold in India to deceive U.S. consumers looking for the same product, the Trademark Trial and Appeal Board said in a precedential decision.

The TTAB ordered Menaaxi Enterprise Inc. to cancel its registrations for “Thums Up’’ and “Limca” because it misrepresented its source. The cola and lemon-lime flavored drinks are popular Coke products in India, which are also sold in the U.S. through third parties in Indian grocery stores and specialty stores.
