CloudFlare Faces Infringement Suit Over Wedding Dress Photos

CloudFlare Inc. lost a bid to derail a contributory copyright infringement suit over wedding gown photographs posted by foreign websites on its content delivery network, because a counterclaim seeking a noninfringement ruling didn’t add anything to the suit, a federal court said.

The “mirror image” rule requires the dismissal of CloudFlare’s declaratory judgment counterclaim against American Clothing Express Inc. and Justin Alexander Inc. because it mirrors the plaintiffs’ copyright infringement suit and doesn’t serve a “useful purpose,” such as seeking to invalidate the plaintiffs’ intellectual property rights, the U.S. District Court for the Western District of Tennessee said.
