Three sons of Baseball Hall of Famer Roberto Clemente are appealing a federal district judge’s opinion barring their trademark claim over the government of Puerto Rico’s use of the late Pittsburgh Pirates player’s likeness on license plates.
Clemente Properties Inc., run by Roberto, Luis Robertor, and Roberto Enrique Clemente, sued in August 2022, accusing the US territory of infringing Clemente Properties’ registered trademark rights and violating the takings and due process clauses of the US Constitution. The island created commemorative license plates and tags to celebrate the 50th anniversary of Roberto Clemente reaching 3,000 career hits in Major League Baseball. ...
