Claim Against Wal-Mart Over Shooting Denied Appellate Review

The family of a man fatally shot by police while holding a pellet gun in a Wal-Mart cannot yet appeal a trial court decision tossing their wrongful death claim against the store, the Sixth Circuit ruled Wednesday.

Judge Chad A. Readler, of the US Court of Appeals for the Sixth Circuit, said the appellate court doesn’t have jurisdiction to consider the district court’s summary judgment grant to Wal-Mart on the wrongful death claim because it’s too similar to the estate’s surviving claims.
