Chewy’s Bid to Sanction IBM Fails in Case Over Internet Patents

A federal judge in New York denied Chewy Inc.‘s motion for sanctions against IBM Corp., finding IBM’s ongoing infringement arguments about a patent following the court’s construction of certain disputed claim terms weren’t frivolous.

“Far from being a cut-and-dry case, resolving the parties’ dispute required that” Judge Jed S. Rakoff “address difficult and highly technical issues of claim construction that had not previously been taken up in this or any other case,” according to his opinion Thursday in the US District Court for the Southern District of New York.
