Chevron’s PTAB Win Over Infineum Engine Lubricant Patent Upheld

Chevron Oronite Co.‘s successful bid to invalidate a lubricating oil patent it was sued for infringing has won the Federal Circuit’s blessing.

Infineum USA LP appealed a Patent Trial and Appeal Board decision that its U.S. Patent No. 6,723,685 is unpatentable as obvious. The U.S. Court of Appeals for the Federal Circuit rejected all of Infineum’s arguments against the ruling in a nonprecedential opinion.

The Federal Circuit disagreed with Infineum’s assessment that the board improperly relied on new theories Chevron raised for the first time in the inter partes review in its reply brief.
