The Patent Trial and Appeal Board improperly relied on an expert’s personal, anecdotal stories to conclude that the risk of injuries from airsoft guns wasn’t considered a problem and thus wouldn’t motivate individuals to combine prior inventions to address it, Vidal said in a decision issued Tuesday.
