Celsius Holdings Inc. sued Eniva USA Inc. seeking a declaration that its line of energy drinks don’t infringe Eniva’s trademarks for “vibe” branded liquid multivitamins.
The complaint filed Thursday in the US District Court for the District of Minnesota alleges there is no likelihood of confusion between the parties’ marks and that Eniva has arbitrarily enforced its purported rights against Celsius while allowing other “vibe” uses in the marketplace. Celsius’ vibe-formative marks are distinctive and associated with Celsius’ popular energy drink line featuring exotic flavor profiles, the complaint said.
