CBS Oldie Records Case Won’t Get Rehearing by 9th Circuit

A federal appeals court won’t revisit its decision that remastering old sound recordings doesn’t amount to a new work under U.S. copyright law.

The U.S. Court of Appeals for the Ninth Circuit Oct. 31 denied CBS Corp.'s request to rehear a case that challenged what law applies to older records.

Congress Oct. 18 enacted the Music Modernization Act, giving new federal protection for sound recordings made before 1972 and used by digital radio, which were previously governed by state laws.
