A federal district court in Florida held that Bio Dose Pharma LLC was liable for infringing on Nutradose Labs LLC’s “Glutadose” mark and for unfair and deceptive practices under the Florida Unfair and Deceptive Trade Practices Act. The court reasoned that because the trademark licensing agreement expired upon bankruptcy, Bio Dose had no lawful right to sell authentic Nutradose products bearing the mark. And the court said that Bio Dose caused actual customer confusion and deceived customers into thinking the two products had the same origin.
