A federal district court in California granted Win Luck Trading Inc.’s motion to dismiss Best International Trading Inc.’s trade dress infringement claim on the grounds that it wasn’t adequately pleaded. The court found that the complaint failed to identify which elements of the packaging are protected. And the court said that Best International failed to argue that the trade dress was nonfunctional and had acquired secondary meaning.
